Terms of Service

The short version

  • Trip Planner is free to use, with ads.
  • Trip Planner Plus is optional. You buy it through the App Store, and Apple handles payment, renewal and refunds.
  • Deleting the app doesn't cancel a subscription. You cancel it in your iPhone's Settings.
  • Travel information comes from Transport for NSW. It can be wrong or change at short notice, so check before you rely on it.
  • Nothing here takes away your rights under the Australian Consumer Law.

Who we are and how these terms fit

Trip Planner Sydney (“Trip Planner”, “the app”) and this website are made by Jerrycan Co Pty Ltd (“we”, “us”), in Sydney, Australia.

You get the app from the App Store under Apple's Licensed Application End User License Agreement (the “Apple EULA”), which is the licence for the app. These terms add to it. By using Trip Planner you agree to both. The Apple EULA reserves the right to change or remove services without notice. Where these terms commit us to more than that, for example what we promise about paid features under Changes to the app, the commitment in these terms applies.

How the app handles your information is set out separately in our Privacy Policy.

Using the app

Trip Planner has no accounts or sign-in; you can use it as soon as it's installed. It's for your own, non-commercial use. Please don't:

  • copy, resell or redistribute the app, or reverse engineer it, except as the law allows;
  • use automated means, such as scripts or scrapers, to extract data from the app or its services;
  • interfere with the app, our server or the services it relies on, or try to get around Trip Planner Plus or ads;
  • use the app unlawfully.

Trip Planner Plus and purchases

Trip Planner Plus removes ads and adds extra features. Depending on what the app offers at the time, you can buy it as an auto-renewing subscription, as a one-off lifetime purchase, or as a pass for a set number of days. Some options aren't always available.

  • Before you buy, the app and the App Store show the price, what you're paying for and, for a subscription, how often it renews.
  • Payment. Purchases are made through the App Store and charged to your Apple Account. Apple handles the payment; we never see your card details.
  • Free trials and offers apply only when the app offers them and only to customers Apple says are eligible. Before you start one, you're shown what you'll be charged when it ends. Unless you cancel before then, the subscription starts and you're charged.
  • Auto-renewing subscriptions renew at the end of each period until you cancel. To cancel, go to your iPhone's Settings → your name → Subscriptions, at least 24 hours before the period ends. Plus stays active until the end of the period you've paid for. Deleting the app doesn't cancel a subscription.
  • Passes last for the number of days shown when you buy one, then simply end. They don't renew, so there's nothing to cancel.
  • Lifetime purchases keep Plus for as long as Trip Planner is offered, without further payments.
  • Refunds are handled by Apple. Ask for one at reportaproblem.apple.com. This doesn't limit your rights under the Australian Consumer Law.
  • Restoring. If you reinstall the app or move to a new iPhone, use Restore Purchases in Settings to get Plus back with the same Apple Account.

Travel information

Journeys, departures, service alerts and stop information come from Transport for NSW, through its website services (transportnsw.info) and its Open Data service. The app reformats them for display. We're not part of Transport for NSW, and the app isn't an official Transport for NSW service.

Timetables, real-time information, platforms and accessibility details can be incomplete, delayed or wrong, and services can change at short notice. Check station signs and official announcements before you rely on the app, especially for accessibility needs or the last service of the night. Don't use the app in an emergency; call 000.

The data sources and their licences are listed in the app under Settings → Acknowledgements. Nothing in these terms limits what a data licence allows you to do with that data.

Ads and other services

The map comes from Apple Maps, and ads are served by Google AdMob. Transport for NSW, Apple and Google provide those parts of the app under their own terms, and we don't control their content. Ads are from advertisers, not recommendations from us. The Privacy Policy explains what these services receive.

Ownership

The app is licensed to you, not sold. We own the app, its design and the Trip Planner Sydney name and icon, apart from the third-party data and software listed in the app's Acknowledgements, which belong to their owners. Please don't use our name or icon in a way that suggests we endorse you.

Changes to the app

We keep improving Trip Planner, so features may change, be added or be removed, and we may stop offering the app. When you've paid for Plus, we commit to the following:

  • What a subscription or pass included when you bought it stays available for the whole period you've paid for, including any billing grace period Apple allows while a renewal payment is retried.
  • What a lifetime purchase unlocks stays available for as long as the app is offered.
  • We won't apply a change to these terms to take away something you've already paid for.

Some features depend on services we don't control, such as Transport for NSW's data. If a change there forces us to withdraw a paid feature, we'll explain it in the app or its release notes. You can then ask Apple for a refund, which Apple decides, and your rights under the Australian Consumer Law still apply.

Your consumer rights and our liability

Our goods and services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that can't lawfully be excluded, restricted or changed.

Apart from those rights, the app is provided as it is and as available. We do our best to keep it working and accurate, but we don't promise it will be uninterrupted, error-free or right for every trip. To the extent the law allows, we aren't liable for indirect or consequential loss, such as a missed connection or appointment, caused by relying on travel information from the app.

Stopping use

You can stop using Trip Planner at any time by deleting it. If you have an auto-renewing subscription, cancel it as well, as described under Trip Planner Plus.

We may block access to our server from a device or connection that's being used to misuse the app in breach of Using the app, for example by scraping or overloading our services.

Governing law

These terms are governed by the law of New South Wales, Australia. If you live elsewhere, you keep any consumer protections the law where you live gives you.

Changes to these terms

When we change these terms, we update this page and the date at the top. We'll mention significant changes in the app's release notes. A change never applies retrospectively to a purchase you've already made.
